These Terms of Service (the ‘Terms’) govern every visit to hearthstonechimneyorlando.com and every service request submitted through it. By using the site or submitting a request - whether by filling out a web form or by calling - a visitor accepts these Terms in full. Anyone who does not agree should not use the site or submit a request.
Important notice: These Terms include a binding arbitration agreement and a class-action waiver. Both are set out in the ‘Dispute resolution’ section below. They affect how legal claims between a visitor and Hearthstone Chimney Co. of Orlando are handled, and visitors should read that section carefully before using the site.
These Terms were last updated on June 28, 2026. Hearthstone Chimney Co. of Orlando may revise them at any time by posting an updated version. Continued use of the site after a revision constitutes acceptance of the revised Terms.
Limitation of liability
hearthstonechimneyorlando.com and the referral service it supports are provided ‘as is’ and ‘as available.’ Hearthstone Chimney Co. of Orlando makes no warranty - express, implied or statutory - that a service professional will be available to handle any particular request, that a business will contact a visitor after receiving a referral, or that any particular outcome or result will follow from submitting a request.
To the fullest extent permitted by applicable law, Hearthstone Chimney Co. of Orlando is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to lost profits, lost data or damage to property, even if Hearthstone Chimney Co. of Orlando has been advised that such damages were possible.
For any claim directly related to the site or the referral service, Hearthstone Chimney Co. of Orlando’s total liability is capped at one hundred dollars ($100.00) or the amount the claimant actually paid to Hearthstone Chimney Co. of Orlando - which in most cases is nothing - whichever is greater. This cap applies to Hearthstone Chimney Co. of Orlando’s own conduct only.
Responsibility for the quality, safety and outcome of any work performed sits entirely with the independent business that performed it, not with Hearthstone Chimney Co. of Orlando. Nothing in this section limits or caps the liability that an independent business may have to a customer for its own work.
How Hearthstone Chimney Co. of Orlando works
Hearthstone Chimney Co. of Orlando operates hearthstonechimneyorlando.com as an advertising and lead-referral service for home services in Orlando, FL and the surrounding areas. When a visitor submits a service request through the site or by phone, Hearthstone Chimney Co. of Orlando passes that request to a licensed local service professional in its referral network. That professional - not Hearthstone Chimney Co. of Orlando - handles the job from start to finish.
Every estimate, repair, installation, service call and any other requested task is carried out by the independent local businesses in that referral network. Hearthstone Chimney Co. of Orlando does not perform home-service work of any kind. It has no technicians, tradespeople, crews or installers on its payroll, and it plays no role in directing or supervising how a referred business does its work.
Scheduling, pricing, the scope of work and the choice of materials are determined by the business that accepts the request. Availability of any particular professional or service type is not guaranteed.
Eligibility
To submit a service request through hearthstonechimneyorlando.com, a visitor must be at least 18 years old and legally capable of entering into a binding contract under applicable law. By submitting a request, the visitor confirms that those conditions are met.
A visitor must also have lawful authority over the property at which any work is requested - either as the owner or as someone with the owner’s permission to authorize the work. Submitting a request for property a visitor does not control is a breach of these Terms.
Text message and call disclosure
By submitting a service request, a visitor agrees to receive calls and text messages related to that request. Those communications may come from Hearthstone Chimney Co. of Orlando and also from the independent service professional or business that receives and handles the visitor’s request through the referral network.
The visitor’s consent covers calls and text messages placed using an automatic telephone dialing system (autodialer) and messages delivered with a prerecorded or artificial voice. Consent to receive these calls or texts is not a condition of purchasing any goods or services.
Message frequency varies depending on the nature of the request and how the receiving business responds. Message and data rates may apply, depending on the visitor’s mobile carrier and plan.
To stop receiving text messages from Hearthstone Chimney Co. of Orlando, reply STOP to any text message at any time. Reply HELP to any message for assistance. Opting out of text messages stops future texts, but it does not automatically close an open service request or stop all other forms of contact about that request - if the visitor wants no further contact about an open request, they should say so explicitly.

Indemnification
By using hearthstonechimneyorlando.com, a visitor agrees to indemnify, defend and hold harmless Hearthstone Chimney Co. of Orlando, its owners, officers, employees and affiliates, and each of the independent businesses in its referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs and reasonable attorneys’ fees arising out of or related to:
- the visitor’s use of hearthstonechimneyorlando.com or the referral service;
- any information the visitor submits, including its accuracy, completeness and the visitor’s authority to provide the phone number and property details given;
- the visitor’s breach of these Terms or of any applicable law or regulation; and
- the visitor’s dealings, disputes or transactions with any business to which the visitor is referred.
This obligation to indemnify and hold harmless survives the end of the visitor’s use of the site or the referral service, regardless of the reason that use ended.
Governing law
These Terms are governed by the laws of the State of FL, without regard to its conflict-of-law rules or provisions. Subject to the arbitration agreement set out in the ‘Dispute resolution’ section, any court proceeding that is permitted under these Terms must be brought exclusively in the state or federal courts located in FL, and both parties consent to personal jurisdiction in those courts.
Dispute resolution
Step 1 - Informal resolution. Before starting any formal proceeding, a visitor agrees to contact Hearthstone Chimney Co. of Orlando through https://hearthstonechimneyorlando.com/contact-us/ and give Hearthstone Chimney Co. of Orlando a reasonable opportunity to resolve the problem. Most concerns can be handled this way.
Step 2 - Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms, the site or the referral service that is not resolved informally will be settled by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as in effect at the time the claim is filed. Arbitration takes place instead of going to court. Both the visitor and Hearthstone Chimney Co. of Orlando give up the right to litigate those claims before a judge or jury in court, except as stated below.
Class action waiver. Claims may be brought only in an individual capacity. The visitor and Hearthstone Chimney Co. of Orlando each waive the right to participate in any class action, collective action, consolidated action, or any class or representative arbitration proceeding. The arbitrator has no authority to consolidate the claims of more than one person or to preside over any form of class or representative proceeding.
Jury waiver. For any dispute that does reach a court under these Terms, both the visitor and Hearthstone Chimney Co. of Orlando waive the right to a trial by jury.
30-day opt-out. A visitor may opt out of this arbitration agreement by sending written notice of that decision within 30 days of first accepting these Terms through https://hearthstonechimneyorlando.com/contact-us/. Opting out of arbitration does not affect any other provision of these Terms.
Small claims and injunctive relief. Either side may bring an individual claim in small claims court, provided the claim qualifies and remains in that court. Either side may also seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent misuse of the site or infringement of intellectual property rights, pending the outcome of arbitration.
Independent businesses - disclaimer of liability
Every business or professional to which Hearthstone Chimney Co. of Orlando passes a service request is an independent contractor. They are not employees, agents, legal representatives, joint venturers or partners of Hearthstone Chimney Co. of Orlando in any sense, and Hearthstone Chimney Co. of Orlando exercises no control over how they perform their work.
Hearthstone Chimney Co. of Orlando is not responsible or liable for: the workmanship of any referred business; the quality, safety or timeliness of the work performed; the pricing charged; whether a business holds the required licenses or adequate insurance; the conduct of that business’s employees or subcontractors; or any act, omission, negligence, injury, property damage or loss caused by or attributable to that business.
The contract for any work is formed directly between the customer and the business that performs it. Hearthstone Chimney Co. of Orlando is not a party to that agreement and assumes no obligations under it.
A referral through hearthstonechimneyorlando.com is not an endorsement, certification or guarantee of any business or its work. Customers are encouraged to confirm a business’s licensing and insurance independently and to obtain and review a written contract or estimate before authorizing any work. Any dispute about the work itself - including defects, damages, unpaid amounts or safety concerns - is a matter between the customer and the business that did the work.
No warranty on work performed; coordination assistance
Because Hearthstone Chimney Co. of Orlando performs no home-service work of any kind, it provides no warranty or guarantee on workmanship, labor, parts or materials. Any warranty on the work itself comes solely from the independent business that performed it, on whatever terms that business offers. Any warranty on parts or materials comes from the manufacturer on the manufacturer’s own terms. Customers should ask the performing business for its warranty terms in writing before work begins.
If a customer is not satisfied with work completed by a referred business, Hearthstone Chimney Co. of Orlando offers one form of assistance: it will act as a go-between by reaching out to the original business to coordinate a return visit, or, if that is not possible, by introducing another provider from its referral network. This is a courtesy coordination effort only. It is not a guarantee that a return visit will occur, that the issue will be corrected, or that any particular outcome will result.
Hearthstone Chimney Co. of Orlando will not perform, redo or repair any work itself, and it will not issue refunds of amounts paid to the business that performed the work. Any claim for a refund or compensation related to work performed must be directed to that business directly.
